The Independent National Electoral Commission (INEC) declared Smart of the APC as winner of the after collation of the supplementary election conducted on Saturday, November 30.

In August, the Kogi state national assembly/state assembly election tribunal had sacked Melaye after an application by Adeyemi that there were irregularities during the election including over-voting and non-compliance with the electoral act.

A re-run election was ordered on November 16 which ended inconclusive due violence and other alleged electoral malpractices.
