Court Stops Army From Demolishing Houses In Ibadan

Residents of Mesiogo Estate at Akobo area of Ibadan, Oyo state have obtained a restraining order against the planned demolition of their property by 2 Division of the Nigerian Army, Adekunle Fajuyi Cantonment.

The residents had filed a suit asking for and were granted an injunction against the intention of the Army by the Oyo State High Court.

The injunction demands the Army stays its hand nor do anything that can threaten their peace pending the determination of the motion filed by the residents.

The residents sought the legal relief after the Army claimed property in the estate are encroaching on military land and thereafter marked them for destruction.

The division had, last week, attempted to intimidate the residents. It took a bulldozer into the area, dug trenches while marking pillars of buildings marked for demolishing.

The residents claim there is no truth to the claim that the properties encroach on military land and say they have survey plans to back up their claims.

In a suit at the State High Court II, Justice A. L. Akintola ordered an interim injunction restraining the Army from “trespassing, demolishing, disposing or further demolishing, disposing or further disposing or in any way interfering with the peaceful enjoyment of the first to fifth claimants’ parcels of land situate, lying and being at Mesiogo Hotel Estate, Alagbode Village, Bodija area, Akobo, Ibadan, Oyo State, pending the hearing and determination of the motion on notice for an order of interlocutors injunction already filed by the claimants/applicants”.

The court adjourned hearing till November 8.
