Court Declares Uche Secondus Arrest By EFCC Illegal, Awards Damages

A Federal High Court in Abuja presided over by Justice John Tsoho has declared the arrest and detention of former Peoples Democratic Party Chairman, Uche Secondus by the Economic and Financial Crimes Commission as illegal and further awarded damages.

EFCC had arrested and detained Secondus in March for allegedly receiving vehicles on behalf of PDP.

Secondus had filed an application at the Federal High Court seeking the enforcement of his fundamental human rights which he deemed violated by the anti-graft agency.

In his application, Secondus requested the court to rule on the legality of his arrest and subsequent detention by the EFCC and also award damages for the infringement of his rights.

The court in effect ruled that the arrest of Secondus by the EFCC is a violation of his rights and as such, illegal.

The court also awarded damages of N10 million against the EFCC in favour of Secondus.

Justice Tsobo in his ruling held that, “The first prayer of the applicant is hereby granted and the sum ‎of N10 million damages is hereby awarded against EFCC”.
