The Court of Appeal in Abuja has thrown out the appeal filed by defeated Kaduna governorship aspirant, Sani Sha’aban, against the victory of Senator Uba Sani at the All Progressives Congress (APC) primaries.
The Court held that the appeal was incompetent because it was argued on an incomplete record of appeal.
Sha’aban had previously appealed against a judgement of the Federal High Court, Kaduna Division, which struck out his suit for lack of jurisdiction.
Barrister Sule Shuaibu, who represented the APC in the case, confirmed the court’s decision and praised the Justices for their thoroughness. “We are pleased that the Court of Appeal has upheld Senator Uba Sani’s victory at the primaries,” Shuaibu said. “This is a clear indication that the democratic process has been respected and that Senator Sani is the legitimate choice of the APC as its candidate for governor of Kaduna.”
The verdict was handed down by all three Justices of the Court of Appeal on Wednesday in Abuja.
With this ruling, Senator Uba Sani remains the APC’s candidate for the governorship election in Kaduna State.
